Abstract

Az F 68342 sz. OTKA kutatás a célkitűzéseinek megfelelően a polgári ügyekben keletkezett bírósági iratok kézbesítésének aktuális kérdéseit dolgozta fel. Ennek egyik fő iránya a határon átnyúló kézbesítés problematikájának, a vonatkozó európai közösségi jogi normáknak és a hozzájuk kapcsolódó bírói gyakorlatnak az elemzése volt. A területet érintő másik kihívásként az információs technológiának a polgári eljárásokban való fokozatos beépülését tekinthetjük. Erre vonatkozott a kutatás másik fő irányvonala. Nem szorítkozott kizárólag az elektronikus kézbesítés feldolgozására, hanem a tágabb szabályozási környezetet igyekezett átfogni. A munka alapját egy komoly összehasonlító jogi vizsgálódás jelentette, amely azt segítheti, hogy a gyakorlat számára világosabbá tegyük határon átnyúló kézbesítésre vonatkozó európai uniós szabályozás összefüggésrendszerét. A kutatás részeredményeit folyamatosan közzétettük. Az eredményeket összegző könyv a kutatás utolsó évében készült el, és 2010 őszén jelenik meg a „Kézbesítés a polgári jogvitákban határok nélkül” címmel a HVG-ORAC Kiadó gondozásában. | According to its objective the research project Nr. F68342 of the Hungarian Scientific Research Fund elaborated the current topics of service of judicial documents in civil matters. One of the main points of the research was the problems of cross-border service of documents, the analysis of the sources of the community law and the case-law of the European Court of Justice. Stepped integration of modern information technologies into civil litigation means the second relevant challenge in the research field of the project that was not restricted to the electronic service of documents, but approached the subject on a much boarder front. A detailed comparative analysis of the regulations of legal systems serves as basis for the research work that supports to clear up the inherence of the regulation of cross-border services. The results of the research have been published continuously. In the last year of the project the result were summarized in book form in Hungarian, which will be published by HVG-ORAC in Budapest.
