Abstract

2012. november 22-én az Európai Unió Bírósága az orvostechnikai eszközök, a nem gyógyászati célú felhasználásra szánt termék fogalmának értelmezése, az áruk szabad mozgása, mint működési alapelv tárgykörét érintően a 93/42/EGK irányelv értelmezésével kapcsolatban – az EUMSZ 267. cikk alapján benyújtott előzetes döntéshozatal iránti kérelem tárgyában – döntést hozott. Döntésével az „orvostechnikai eszköz” fogalmának terjedelmét, célhoz kötöttségére tekintettel pontosította. A bíróság határozata kötelező nemcsak az előzetes döntéshozatal iránti kérelmet kezdeményező nemzeti bíróság, hanem a tagállamok valamennyi bírósága számára is. Hivatalos hivatkozás: Az Európai Unió Bíróságának 2012. november 22-én a C‑219/11. sz. ügyben, az EUMSZ 267. cikk alapján benyújtott előzetes döntéshozatal iránti kérelem tárgyában kelt ítélete. Hetil., 2013, 154, 391–393. | The Court of Justice of the European Union made a decision on medical devices as non-medicinal products for intended use in interpreting the concept of free movement of goods, such as operating principles concerning the subject matter of the interpretation of Directive 93/42/ EEC – in preliminary ruling according to article 267 of TFEU – on 22 November 2012. With its decision, given assigned explained the concept of the scope of medical devices. The decision of the Court is binding not only for the national court initiating a request for the preliminary ruling, but also for all courts of the Member States.
