Abstract

A kutatás során feltártam a magyar parlamentarizmus és alkotmányfejlődés történetét 1989 és 2011 vége között. A kutatás egyesítette az alkotmányjogi és a politikatudományi megközelítést, révén a közjogi átalakulások és jogesetek politikai hátterét feltárva magyarázta a jogállamiság és a kormányforma tartalmi fejlődését, alakulását. A kutatás ciklusonként haladva mutatta be a választásokat, a parlament megalakulását, működésének sajátosságait, elemezte a parlamenti jog és funkciók fejlődését, valamint a főbb közjogi eseteket. A Kutatás összefoglalója elvégzi a parlamentarizmus főbb ismérveinek immár nem ciklusonkénti dimenzióban való áttekintését, a főbb állami szervek szabályozásának, a személyi döntéseknek, az alapjogvédelemnek és mindezek alapján a magyar demokrácia jellegének elemző bemutatásával. A kutatás végén arra az álláspontra helyezkedtem, hogy a parlament hatáskörgyakorlásának ismérvei, az alkotmányos intézmények működési tapasztalatai és a politikai erők (elitek) stratégiája nyomán a még nem régiben is konszenzusosnak tartott magyar demokrácia-típus alapvetően inkább a többségi modellhez tartozik. | The research helped to summarize the history of the Hungarian parliamentarism and constitutional develepoments between 1989-2011. The research combined the methodology of constitutional law and political sciences, since the political background of the constitutional changes and case-law helped to interpret the development of rule-of-law and the form-of-government. From terms to terms of the parliament, the research documented the elections, the constituent sessions of the legislative, features of its functioning, analysed the parliamentary functions and the legal regulation thereof, and the most important legal cases. The summary of the research outlines the main features of Hungarian parliamentarism, the regulation of the main state organs and fundamental rights, the personal decisions - and finally the character of the Hungarian democracy. At the end, I take the position that the Hungarian political system can be regarded as a majoritarian one, regarding the competencies of Parliament, the practice of the state organs, and the strategies of the political forces (elites) - rather than a consensual one, as it was considered even till recently.
