Abstract

A kutatás fő célja egy modern, kritikus kiadása volt a szerződési formuláknak. Kiindulópontul egy régi művet választottunk a XVI. századból: De formulis et solemnibus populi Romani verbis libri VIII. A kutatás lényege a humanista munka digitalizálása és kiegészítése volt, egy kommentált szövegkiadás előállítása. A munkát a szerződési jogra koncentráltuk. Szükséges volt az időközben publikált források beemelése, pl. G. Camodeca, Tabulae Pompeianae Sulpiciorum, Roma 1999. Már Ernst Rabel rámutatott a klasszikus római jog kazuisztikus szerkezetére és hangsúlyozta, hogy a felelősségi és veszélyviselési szabályok csak e kazuisztika keretében ismerhetők meg; javasolta a szerződési típusokon belüli differenciálást a szerződés tárgya szerint. Ezt a gondolatot követik az elkészült publikációk, de meglepően már Brissonius is ebben a felfogásban dolgozta fel a római szerződési jogot. A kutatási projekt eredménye, a publikáció is ezt az elvet követi és az egyes szerződéseket szocio-ökonomikus kontextusukban elemzi. A szerződési minták szisztematikus összegyűjtése és a tipikus szerződési klauzulák kiemelése izgalmas panorámát kínál a jogéletről. Szükséges volt továbbá a humanista tudós értékes munkájának kiegészítése az új epigráfiai forrásokkal, az időközben kiadott latin nyelvű okiratokkal. Brissonius latin nyelvű szövegeit magyarra fordítottuk és részletes kommentár igyekszik megkönnyíteni a modern olvasó számára a komprimált utalásokat és idézteket a szerződési formulákból. | The main goal of the project was creating a modern, revisited collection of contract formulas. We worked on the collection of Barnabas Brissonius from the 16th century: De formulis et solemnibus populi Romani verbis libri VIII. The main goal was revising this work, focused on contract law. It was also necessary to add new sources, published in the meantime, for example G. Camodeca, Tabulae Pompeianae Sulpiciorum, Roma 1999. Ernst Rabel pointed out the casuistic character of responsibility and risk rules in ancient Roman law and argued for a separate treating. It seems to be very surprising but already Brissonius recognised this principle and structured the main groups of his work. The main product of the project, the ready volume follows his idea and treats the special types of each contract (special socio-economical contents) separately. The systematical collection and redaction of contract drafts and typical contract clauses from the commentary works of the classical Roman jurists and from the ancient literature offers an interesting view for the modern reader. It was also necessary to collect and comment the new published Latin documents about contract law (epigraphical sources)and add it to the valuable work of our humanist. The Latin texts of Brissonius were translated into Hungarian, for making it fit for the modern readers. A detailed commentary makes it easy to understand the short clauses and hints to every day legal life.
