Abstract

Az Európai Parlament és a Tanács 1215/2012/EU rendelete a polgári és kereskedelmi ügyekben a joghatóságról, valamint a határozatok elismeréséről és végrehajtásáról, noha már több mint hét éve hatályban van, annak alkalmazásával kapcsolatban a mai napig számos kérdés kerül az Európai Unió Bírósága elé. A tanulmány bemutatja a rendelet értelmezésével kapcsolatban a Bíróság döntéseit különös tekintettel a rendelet tárgyi hatályára, valamint a joghatósággal összefüggő kérdések viszonyában, amelyen belül foglalkozik a kizárólagos és különös (szerződéses és kártérítési ügyekkel összefüggő) joghatósággal. = Although the Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters has been in force for more than seven years, many questions on its application are still being raised before the Court of Justice of the European Union. This paper describes the most important decisions of the Court of Justice in relation to the interpretation of the Regulation with reference to its scope and jurisdiction rules, especially the special and exclusive jurisdiction rules in case of contractual and tort law cases.
