Abstract

Magyarország Alaptörvényében alapelvként rögzítették, hogy „Magyarország a béke és a biztonság megteremtése és megőrzése, valamint az emberiség fenntartható fejlődése érdekében együttműködésre törekszik a világ valamennyi népével és országával”.2 A Büntető törvénykönyvről szóló 2012. évi C. törvény 146. § (1) bekezdésben rögzített fordulat a tiltott toborzás és az ehhez kapcsolódó magatartásokkal, míg a Btk. 146. § (2) bekezdés szerinti fordulat a fegyveres összeütközésben részt vevő idegen fegyveres szervezetben történő önkéntes részvétellel szemben lép fel.3 A tanulmányban elsőként a tiltott toborzás magyar Büntető Törvénykönyvben elfoglalt helyét mutatjuk be, majd a béke és a háború tárgyalása következik. A tanulmány feltárja a tiltott toborzás első és második fordulatának speciális jegyeit, végül pedig egy jogesetet ismertetünk. | The Fundamental Law of Hungary states as such a principle that: „In order to create and maintain peace and security, and to achieve the sustainable development of humanity, Hungary shall strive for cooperation with all the peoples and countries of the world.”4 Section 146(1) of Act C of 2012 on the Criminal Code deals with illegal recruitment and related behaviours, Section 146(2) acts against voluntary participation in a foreign armed body participating in an armed conflict.5 The study first presents the place of illegal recruitment in the Hungarian Civil Code, followed by a discussion of peace and war. The study reveals the special characteristics of the first and second round of illegal recruitment, and finally a legal case is also described.
