Abstract

The C 519/19 judgment of the European Court of Justice in Ryanair v Delafix case not only enriches the case-law of the Air Passenger Rights Regulation, but also provides clear guidance on sensitive issues related to the business models used to enforce the air passenger rights. Can a legal person acquiring a consumer's claim by assignment be bound by a jurisdictional clause in an online contract between the air carrier and its original passenger? To what extent does the competent court of a Member State have the right in proceedings between the assignee undertaking and the air carrier to examine the unfairness of the jurisdictional clause contained in the initial contract?
