Abstract

Magyarországot az Emberi Jogok Európai Bírósága már több alkalommal marasztalta el a jogerősen tényleges életfogytig tartó szabadságvesztésre ítéltek kötelező kegyelmi eljárásával összefüggésben. Az Emberi Jogok Európai Egyezményébe foglalt kínzás tilalmának sérelme lényegében a szóban forgó büntetés mértékének tényleges csökkenthetőségének, az alkotmányjogi panaszok ezzel összefüggő hatékonyságának, valamint a tagállami mérlegelési szabadság korlátozottságának a kérdéskörére vezethető vissza. Jelen tanulmány keretében e három tényezőt veszem vizsgálat alá, különös tekintettel a Strasbourgi Bíróság joghatóságára és esetjogára. | Hungary has been condemned by the European Court of Human Rights several times in connection with the mandatory pardon procedure for prisoners sentenced to life without parole. The violation of the prohibition of torture contained in the European Convention on Human Rights can essentially be traced back to the issue of the de facto reduction of the punishment in question, the related effectiveness of constitutional complaints, and the limitation of the member states’ margin of appreciation. In the context of this study, I will examine these three factors, with particular regard to the jurisdiction and case law of the Strasbourg Court.
