Abstract

Az Emberi jogok európai egyezménye és az Európai Unió Alapjogi Chartája párhuzamosan szabályozza az alapjogokat. Ezek elemzése mellett a tanulmány kitér arra is, hogy az egyes jogok magukban foglalnak-e más jogokat: például az igazságszolgáltatáshoz való jog több jogosítványt felölel, így nemcsak egy önmagában álló jog, hanem más jogok megvalósulását is elősegíti, többek között a tisztességes eljáráshoz és a jogorvoslathoz való jogot. Az egymást átfedő vagy kiegészítő részekről is szó esik a tanulmányban, és ezen túlmenően, a két nemzetközi szervezet viszonyára is rámutatnak a szerzők, a közös európai em¬berijog-védelem kapcsán, különös tekintettel a büntetőeljárási jogokra. | The European Convention on Human Rights and the Charter of Fundamental Rights of the European Union regulate fundamental rights in parallel. In addi‐ tion to analysing these rights, the study also takes into account whether each right also includes other rights: for example, the right to access to justice includes several rights and is therefore not only a right in itself, but also contributes to the realisation of other rights, including the right to a fair trial and the right to rem‐ edy. The paper also discusses the overlaps and complementarities between the two international organisations in the context of common European human rights protection, in particular with regard to criminal procedural rights.
