Abstract

Th is introductory chapter will outline some of the elements of the Pan-European concept of the freedom of the press, while respecting the individual characteristics of each European state as regards the details of press freedom. I will work on the assumption that freedom of the press has elements in common in democratic European states that make it possible to identify a ‘ European ’ doctrine. It is important in this context to understand freedom of the press as a right that generally guarantees the freedom of all media. I will not cover issues of ‘ media regulation ’ , although television, radio and on-demand media services are subject to a separate regulatory regime and slightly distinct constitutional doctrines. Similarly, the freedom of online platforms that have characteristics other than those of legacy media but which play a similar role in the public sphere is treated as a separate issue. Freedom of the press is therefore the freedom of all channels of communication that can be covered by the notion of ‘ press ’ or generally the ‘ media ’ , but it does not include media or Internet (platform) regulation.
