Abstract

A megosztáson alapuló gazdaságban a vállalkozások és az egyének együttműködnek annak érdekében, hogy javítsák a gazdasági hatékonyságot és maximalizálják az erőforrások felhasználását. Ez sok esetben a technológiai innováció és a kreativitás új formáit is előhívja, és elterjedésével hozzájárulhat a fenntarthatósághoz, az árak csökkenéséhez és új munkahelyek teremtéséhez. Azonban a modell alapvető problémákat hordoz magában, amire a már hatályos jog részben fel is volt készülve. A meglévő szabályozás alkalmazásával csak a felmerülő kérdések egy részére lehetett választ adni, ezért a jogalkotó figyelme a megosztáson alapuló gazdaság főszereplői, a platformok felé irányult. A tanulmány célja, hogy röviden bemutassa a közösségi gazdaságot, a belőle származó gondokat, a már hatályos jog azokra adott megoldásait, és azt is, hogyan kezeli azokat az új európai platformjog. | In the sharing economy, businesses and individuals work together to improve economic efficiency and maximize the use of resources. In many cases, this also gives rise to new forms of technological innovation and creativity, and by spreading, helps to promote sustainability, reduce prices and create new jobs. It allows for better use of resources than traditional economic models. However, the model has problems inherent in its basic model. For which existing law was mixed. Only some of the issues raised could be addressed by applying existing legislation. Thus, the legislator’s attention was directed towards the main players in the sharing economy, the platforms. The aim of this paper is to briefly describe this sharing economy, the problems it poses, how some of these have been addressed by the existing solution, and how they are addressed by the emerging new European platform law.
