Abstract

A tanulmány a hatósági felügyelet általános jellemzőit és a DSA-ban létrehozott felügyeleti rendszert vizsgálja. E körben érinti a Digitális Szolgáltatások Európai Testülete és az Európai Bizottság szerepkörét, valamint részletesen elemzi a digitális szolgáltatási koordinátornak mint a felügyelet tagállambeli fő letéteményesének hatásköreit, a hatáskör feladattelepítési és eljárási cselekményekre vonatkozó, valamint a döntéshozatal kereteit kijelölő értelmében is. Vizsgálja a DSA szerinti felügyeleti hatáskör gyakorlásával összefüggő magyar szabályozást is, emellett kitér a közvetítő szolgáltatások határon átnyúló jellegéből adódó sajátosságokat kezelni hivatott együttműködési és eljárási formákra, valamint a digitális szolgáltatási koordinátor egyes, a felügyeleti tevékenységén kívül eső, de azzal összefüggésben álló tanúsítási-jogosítási, egyúttal nyilvántartásvezetési feladataira, és e körben a hazai szabályozásra. | The study examines the general features of public oversight and the oversight system established by the DSA. In this context, it touches upon the role of the European Digital Services Board and the European Commission, and analyses in detail the competences of the Digital Services Coordinator as the main depository of supervision in the Member States, in terms of the allocation of powers, as well as procedural acts and the framework for decision-making. It examines the Hungarian regulation related to the exercise of the supervisory powers under the DSA. It will also address the forms of cooperation and procedures to address the specificities of the cross-border nature of intermediary services, as well as certain certification, authorisation and registering tasks of the Digital Services Coordinator, which are outside the scope of its supervisory activities but are related to them, with sight on the domestic regulation as well.
