Abstract

Környezetünk védelmének gondolata nem újkeletű, már a Bibliában is szerepelt erre vonatkozó utalás, de talán sosem volt még ennyire időszerű. A jogi szabályozásnak fontos szerepe van a környezetvédelem fenntartásában és fejlesztésében,így több jogág is foglalkozik az erre vonatkozó kérdésekkel. A szerző a magyar alkotmányjog és annak alapjául szolgáló Alaptörvény szempontjából tárgyalja különösen a nemzeti vagyonnal és a felszín alatti vizek védelmével kapcsolatos alkotmánybírósági gyakorlatot. A határozatok egyértelműen tanúsítják, hogy a környezetvédelem nem csupán az államcélok deklaratív megfogalmazásának szintjén jelenik meg bennük, hanem az egyéni jogvédelemhez kapcsolódó módon is. | The idea of protecting our environment is not a new one, it was mentioned in the Bible, but perhaps never before has it been so timely. Legal regulation has an important role to play in maintaining and improving environmental protection, and several branches of law are concerned with this issue. In particular, the author discusses the practice of the Constitutional Court in relation to national property and the protection of groundwater from the perspective of Hungarian constitutional law and the underlying Fundamental Law. The decisions clearly attest that environmental protection is not only present in them at the level of declarative formulation of state objectives, but also in a way related to individual legal protection.
