Abstract

Jelen tanulmány a véleményszabadság jelenségével, belső ellentmondásaival,a véleménynyilvánítás, a kifejezés szabadságának jogi fogalmával, tartalmával foglalkozik. Bemutatja jogtörténeti eredetét, kötödését a reformációhoz,illetve bemutat néhány jogfilozófiai tartalmú megállapítást, értékelést. Ezen bevezető részek után a tanulmány alapvetően a véleményszabadság, lelkiismereti szabadság, a kifejezés szabadságának román alkotmányi szabályozását mutatja be, valamint az ezekkel kapcsolatos néhány alkotmánybírósági határozatot. A tanulmány az alkotmányi alapjogi rendelkezéseken, valamint az alkotmánybírósági esetgyakorlat elvi megállapításain keresztül ismerteti a román alkotmányjognak, szabályozásnak és alkotmányértelmezésnek a főbb sajátosságait. | This study presents the meaning of the freedom of opinion, its internal contradictions, as well as the legal content of the expression of opinions and the freedom of expression. It points out its legal historical origin, its connection to the Reformation, and presents some findings and evaluations with a legal philosophical content. After these introductory parts, the study basically sets forth the Romanian constitutional regulation of freedom of opinion, freedom of conscience and freedom of expression, as well as some related decisions of the Constitutional Court. The study describes the main characteristics of Romanian constitutional law, regulations and interpretation through the provisions of fundamental rights and liberties enshrined in the Constitution and the principles that result from the case law of the Constitutional Court.
