Abstract

A tanulmány a European Model Rules on Civil Procedure (Rules), a European Law Institute és az UNIDROIT együttműködési folytán létrejött polgári perjogi modellszabály és hatályos perrendtartásunk viszonyát vizsgálja elsődlegesen az elsőfokú eljárás szerkezetén keresztül. E terület 2013 óta hazai perjogi irodalmunkban kiemelten citált, ami jelentőségére és újszerűségére tekintettel indokolt is. A Rules célja, hogy a harmonizáció eszközével soft law jelleggel hatást gyakoroljon a nemzeti perjogokra és azokat lehetőleg egy irányba terelje. A vizsgálattárgyát az képezi, hogy az azzal egy időben létrejött perrendtartásunk esetén ez megvalósulhatott-e, illetve a későbbiek során megvalósulhat-e. Mindeközben a tanulmány felvillantja perrendtartásunk szerkezetének legfontosabb jellemzőit. | The study examines the correlation of the Hungarian Code of Civil Procedure (HCCP) in force and the European Model Rules on Civil Procedure (Rules), which is a model rule adopted by the European Law Institute and the UNIDROIT mainly from structural aspect. Since 2013 this field of the procedural law is highly cited in the Hungarian legal literature because of its importance and novelty. The aim of the Rules is to make an impact to the national procedural law by means of soft law and further harmonise such laws. The subject of the examination is whether the simultaneously adopted Rules and HCCP have any past and future impact on each other. While the study lights up the main features of the HCCP’s structure.
