Abstract

Az utóbbi évtizedek hazai jogirodalmában és ítélkezési gyakorlatában vitatott kérdésként merült fel a közokirat-hamisítás elkövetési magatartásainak, a közokirat fogalmának, valamint e bűncselekmény körében felmerülő halmazati kérdéseknek az értelmezése. Nem véletlen, hogy a Kúria számos jogesetkapcsán érintette e szempontokat. E tanulmány elsősorban a szóban forgódogmatikai kérdések tisztázására, valamint a legfőbb bírói fórum ítélkezési gyakorlatának elemzésére fókuszál, amelynek során a szerző célja a legújabb eseti döntések, illetőleg a témában gyakran hivatkozott szerzők álláspontjainak ismertetése és elemzése. | In the domestic legal literature and case law of the last decades, the interpretation of the offence of forgery of public documents, the concept of public documents and the cumulative issues arising in the context of this offence have been a controversial issue. It is not by chance that the Curia has addressed these aspects in a number of cases. The present study focuses primarily on clarifying these doctrinal issues and analysing the case law of the Hungarian Supreme Court, with the aim of presenting and analysing recent case law and the opinions of authors frequently cited on the subject.
