Abstract

Mi az igazság? E kérdés mindmáig fontos és megoldatlan kérdése a filozófiai és a társadalmi gondolkodásnak egyaránt. A vizsgálódás dimenzióját a büntető igazságszolgáltatás területére szűkítve azonban már nem pusztán az ’igazság’1 fogalma, hanem önmagában az igazságkeresés fontossága és formája is attól függ, hogy melyik jogcsalád igazságszolgáltatási rendszerében járunk el. Az eltérő paradigmák alapján szerveződő eljárások ugyanis eredendően másképpen közelítik meg az igazság, az igazságkeresés jelentősége, s így a büntetőeljárásban a terhelttel köthető megállapodások lehetőségének kérdését is. A tanulmány elsősorban leíró és összehasonlító módszerrel veszi górcső alá a terhelt és az állami vádhatóság között köthető megállapodás bölcsőjeként ismert amerikai szakirodalmat, majd vetíti rá arra az egyezségkötés magyar jogszabályban rögzített módját, melyből a szerző általános jellegű következtetéseket igyekszik levonni. | What is truth? This question is still a crucial and unsolved question of both philosophical and social literature. Narrowing down the dimension of the analysis to the area of criminal justice, however, not only the concept of ’truth’, but also the importance and form of the search for the truth in itself depends on the judicial system we are acting in. Criminal procedures based on different paradigms naturally approach the question of truth, the importance of the search for truth, and thus the possibility of agreements with the accused in criminal proceedings, in a different way. This paper primarily uses a descriptive and comparative method to examine the American literature, known as the base of the agreement between the accused and the prosecutor and then examines the method of reaching a settlement with the defendant defined in the Hungarian criminal procedure law, from which the author attempts to draw general conclusions.
