Abstract

Az Erdélyi Nagyfejedelemség önálló államfejlődésének utolsó évtizedeiben a rendi eredetű széttagoltság és a nemzeti eszme megjelenésének kihívásaival szembesült. Az erdélyi állam e tárgyban végül alkotmányfejlődésének betetőzéseként a középkori alkotmányos rendszerét sajátos megoldással újította meg, amely alapjaiban tért el az anyaország nemzetiségi kérdésre adott válaszától. Az Unio Trium Nationum törékeny alkotmányjogi rendszerét Erdélyben felváltotta jogalkotási szinten egy a korszellemnek megfelelő új, a modern nemzeti eszme elemeit integráló alkotmányos környezet, amely egy multikulturális állam képét vetítette előre. Az a körülmény, hogy ez az államszervezet végül nem teljesedhetett ki mégis napjainkra ható üzenetet hordoz magában, nevezetesen a nemzeti kisebbségek kérdésének tartalmi egyenlőség és alkotmányosság útján való megoldásának legitimitását. | In the last decades of its development as an independent state, the Principality of Transylvania faced the challenges of the emergence of the national idea and the fragmentation of the Estates and particularism. In this aspect, the Transylvanian state finally culminated its constitutional development by renewing its medieval constitutional system with a specific solution, which differed fundamentally from the motherland’s response to the nationality question and challange. In Transylvania, the fragile constitutional system of the Unio Trium Nationum was replaced at the legislative level by a new constitutional environment in keeping with the spirit of the times, integrating elements of the modern national idea and projecting the way of a multicultural state. The fact that this state organisation could not be completed in the end nevertheless sends a message that is still relevant today, namely the legitimacy of resolving the issue of national minorities through substantive equality and real constitutionalism.
