Abstract
Der nachfolgende Beitrag stellt aus der ausufernden deutschen Judikatur zur Brüssel Ia-VO im Zeitraum 2022-2023 fünf ausgewählte Entscheidungen zur Anerkennung und Vollstreckung vor. Zwei davon betreffen das Verhältnis von Brüssel Ia-VO und EuVTVO, eine dritte die Abgrenzung von Entscheidung und Zwangsvollstreckungsmaßnahme sowie die Folgen der Versäumung der Arrestvollziehungsfrist eine vierte die Bedeutung des Formblatts nach Anhang I und die fünfte das Verhältnis des unionalen Vollstreckungsschutzes nach Art. 44 Brüssel Ia-VO zum nationalen Vollstreckungsschutz. | The following article presents five selected decisions on recognition and enforcement from the proliferating German case law on the Brussels Ia Regulation in the period 2022-2023. Two of them concern the relationship between the Brussels Ia Regulation and the EuVTVO, a third concerns the distinction between a judgement and an enforcement measure and the consequences of failing to comply with the attachment enforcement period, a fourth the significance of the form set out in Annex I and the fifth the relationship between the European enforcement protection under Art. 44 Brussels Ia Regulation and national enforcement protection.
