Abstract
The 1864 Romanian Civil Code, modeled on the French Code Civil, symbolizes an essential moment in Romania’s legal modernization and its aspiration to align with Western legal traditions. Rooted in the ideological framework of the 1848 revolutionary movement, the Code’s adoption highlights the dynamics of legal transplant, involving both opportunities and challenges. This article examines the historical context of Romanian codification, the cultural tensions surrounding the integration of foreign legal norms, and the interaction between Western influence and local realities. By analyzing seven key arguments for and against the Code’s adoption, the study reveals the enduring implications of legal transplants for national identity, modernization, and legal harmonization in the global and European contexts.
