Abstract

Jelen tanulmány arra tesz kísérletet, hogy kutassa a tradicionális jog forrásait Dósa Elek Erdélyhoni jogtudomány című művében, és rámutasson arra, hogy a Dósa Elek művében felvázolt régi erdélyi jog javarészt középkori alapokon nyugszik, a középkori alapokat pedig a Tripartitum közvetítette. További történeti kutatás alapján a tanulmány arra a következtetésre jut, hogy a Tripartitum szokásjogról szóló fejezetei a 16.századnál is régebbre nyúlnak vissza, és a középkori közös jog jogtudósainak, a glosszátoroknak a tanításain alapulnak. | The present paper attemptsto show the influences of the European legal thinking in Elek Dósa’s Erdélyhoni Jogtudomány and to point out that the old Transylvanian law outlined in Elek Dósa’s work is largely based on medieval foundations, and that these medieval foundations were transmitted by the Tripartitum. On the basis of further historical research, the study concludesthat the chapters of the Tripartitum on customary law date back even further and are based on the teachings of the medieval legal scholars, the glossators and commentators who taught law in the medieval universities.
