Abstract

As a judge assigned to the Public Administration College of the Győr Court, I adjudicate in public administrative cases. In addition to my work as a judge, I research the system of agricultural subsidies and judicial case law as a third-year PhD student. The purpose of my doctoral thesis is to provide a comprehensive picture of the domestic system of agricultural support and the legal practice of agricultural support law by reviewing the literature on agricultural law, domestic and European Union legislation, the practices developed at economic organizations, agricultural and rural development support bodies, and the case law gathered in courts. The questions examined during the research refer to the normative clarity of the agri- cultural subsidy legislation, the equivalence of the functions assigned to agricultural subsidies and the precedent-setting practice available in the subject area. I claim that the right to support agriculture is characterized by an effect called the paradox of complex systems. The phenomenon indicates a complex regulatory environment that makes it impossible to understand even the simplest regulated part of the system without knowledge of the entire system. The article explores the agro-environmental management relationships of agricultural support law. As a part of this, it provides a thorough analysis of the failure of agricultural support measures aimed at reducing the effects of agricultural management on the environment and the current environmental and climate policy efforts of the Common Agricultural Policy. My research aims to help legal practitioners understand agricultural support law, a special field suitable for implementing complex functions.
