Abstract
Conflict is an inherent part of everyday life, the quick resolution of which is an expectation of the persons concerned. In disputes arising in economic and commercial relations, there is an increased demand for the fastest and most discreet resolution of the conflict due to the special nature of the legal relationship between the parties. If the parties cannot resolve this between themselves, without an intermediary, they can use the possibilities offered by the regular court procedure, or they can also bring their conflict to arbitration. There are several advantages and disadvantages to both procedures – such as duration, flexibility/formality, expertise, closed proceedings/publicity, costs, procedural fees, language of the procedure) – which can be weighed by taking into account all the circumstances of the given case in order to determine which type of procedure is the most appropriate choice for the parties involved in the legal relationship. Arbitration proceedings, which have a long history in our country as well, have a strong raison d’être compared to regular court proceedings owing to several of their distinct characteristics.
