Abstract

The topic of symbolic legislation and symbolic criminal law is less researched in Hungary. The issue of symbolic legislation and symbolic criminal law in particular raises serious theoretical and practical problems. Criminal legislation must not only serve to protect society, but also to ensure that punishments are necessary, proportionate and in accordance with the principles of the rule of law. Symbolic legislation, in which the rules of criminal law convey a social message rather than aiming at real practical application, can be problematic if the legislator has no intention of applying the law and is guided only by political intentions or a sense of social security. The symbolic nature of criminal law does not necessarily conflict with the legislator’s objectives, provided that it is not merely an empty, formal provision but reflects the substantive content of the legal norms. Taking into account fundamental legal principles such as necessity, proportionality, and the rule of law, symbolic nature can be seen as positive if it serves a substantive purpose of criminal law-making and is not merely aimed at achieving social tranquillity or political ends.
