Abstract
Combating cyberbullying is an uphill battle which must be fought even against all odds. The evolution of the relevant French laws has so far produced an intricate web of formally sui generis norms which revise and update one another and the end of the road is not in sight. This reflects a reactive approach: a rapidly changing technological and social environment gives rise to a rapidly changing, increasingly complicated and detailed legal environment. In the view of this writer, French lawmakers could as well have chosen a different path: a solid, elaborate dogmatic framework provided for by the Press Act and the Penal Code with only rare amendments in case of compelling necessity so as to leave the rest to judicial practice.
