Abstract
The Constitution of the Italian Republic1 guarantees anyone the right to freely express their thoughts in speech, writing, or any other form of communication.2 This freedom is not absolute, there are several explicit and implicit limitations to the right to freedom of expression in the Italian legal system. However – unlike for example the Fundamental Law of Hungary – the Constitution of Italy does not contain any explicit provisions on this fundamental right that could be considered as a prohibition of hate speech. But over time, several laws have been adopted which penalize various forms of discrimination and hate speech.
