Abstract

A tanulmány főleg azzal foglalkozik, hogyan hatott a modern kapitalizmus megszületése a kereskedelmi jogra. Ezen belül fő figyelme arra irányul, hogyan ment végbe a modern nyugat-európai kereskedelmi jog kodifikációja, és hogy annak milyen elméleti előzményei és gyakorlati következményei voltak. A tanulmány arról is értekezik, hogy mi volt az akkori kereskedelmi jog helye a magánjog és a közjog koordináta-rendszerében. Erre a kérdésre sokáig nem volt egyértelmű válasz. A cikk végül külön figyelmet szentel a monista és a dualista felfogás megnyilvánulásainak is. | The paper primarily examines the impact of the birth of modern capitalism on commercial law. It places particular emphasis on how the codification of modern Western European commercial law took place and what its theoretical antecedents and practical consequences were. It also discusses the place of commercial law in the coordinate system of private and public law. For a long time this question remained unsettled. Finally, the article pays particular attention to the manifestations of the monistic and dualistic conceptions.
