Abstract

It is almost a century-long tradition in Italian radical left-wing politics to save prominent members of the movement from what their supporters consider to be unjust convictions or imprisonments by nominating them as candidates and then electing them to take advantage of their parliamentary immunity. Such tactics are increasingly not alien from the far right either. Yet are they morally permissible ways of using the ballot? I argue that they are—but only under certain conditions. Nominating parties and voters should consider the injustice of these unjust convictions and imprisonments in the context of other injustices and may address the former injustice in the electoral process only if doing so is consistent with realizing justice more broadly through elections. Parties and voters should, however, be allowed a limited degree of partisan preference in deciding how to act on reasons of justice in elections.
