Abstract
This study examines the normative framework governing mistakes under Austrian private law, alongside its doctrinal interpretation and practical application. It compares the original text of the Allgemeines Bürgerliches Gesetzbuch (ABGB, Austrian Civil Code) with the current statutory provisions and analyses the various categories of mistakes recognized in Austrian jurisprudence. These categories include mistakes in declarations (Erklärungsirrtum), mistakes in the content of the contract (Geschäftsirrtum), and mistakes in motive (Motivirrtum). Particular attention is given to the distinction between essential and non-essential mistakes, the circumstances under which mistakes arise and can be identified, and the legal consequences that follow from them. The concluding section provides a comparative analysis of the provisions on mistakes in the German Bürgerliches Gesetzbuch (BGB, German Civil Code) and the Austrian ABGB, highlighting their similarities and differences.
