Abstract
The situation of a party in civil proceedings can also be described by terms – not yet used in legal literature – in which intellectual and emotional factors also play a role. As far as we are convinced, these circumstances, which determine the position of the party in the proceedings, are expressed precisely in the terms objective factual situation and subjective state of consciousness. Objective factual situation is a circumstance determined by evidence (facts) available at a given moment, which can be obtained later during the proceedings, while the subjective state of consciousness describes the changing psychological and emotional mood of the litigant during the proceedings, which is largely determined by the existence or absence of evidence to substantiate the party’s claims. The ratio between the objective factual situation and the subjective state of consciousness, evidence (object), and the state of the party involved in proceedings (subject) together shows the effectiveness of their procedural actions.
