Abstract

The legislative change to the Penal Enforcement Act, which entered into force in the spring of 2024, can also be interpreted as a paradigm shift in the penal institutional system. The category and credit system outlined in the law addresses the mistakes of the previous regime and its consequences, and responds to them in a meaningful way. It outlines a transparent, closed institutional path for prisoners, where the ultimate goal is not the attainment of the ideal image of a “good prisoner,” but to live as a law-abiding citizen outside the prison after a successful reintegration into society. The category and credit system is characterized by the principles originating in the penal institutional systems of Western European countries, such as progressivity, predictability, individualization and personalized motivation. The study discusses the most important provisions of the legislative change from a criminological perspective, with particular attention to the criminological theories supporting the new legislation. It highlights the most important aspects of the category and credit system, while also identifying questions to which the professional community expecting results from the new system has not yet received satisfactory answers.
