Abstract
In this article, I examine the relationship between railway passengers and the railway administrative authority regarding complaint handling, as it culminates in Curia judgments of 2025, offering conclusions, lessons, and reflections. In these cases, the plaintiff is the public prosecutor, which makes the legal approach particularly interesting. Although the prosecutor was unsuccessful in these proceedings, he quickly reached his goal in a 2025 consumer protection authority case: in our view, the prosecutor’s intervention proved effective against an administrative attempt that was contra legem and contra constitutionem. The judgments of the administrative lawsuits discussed here also provided indispensable ammunition. The Curia’s decisions analyzed in the article reaffirm that a consumer, under the Consumer Protection Act – even as a railway passenger – may act as an applicant and party in administrative proceedings, while in the “sui generis” passenger complaint-handling procedure, the matter falls within the scope of discretionary power.
