Abstract

One of the greatest environmental challenges of the future is to adequately meet water needs and to address waterrelated environmental problems. It is the duty of the state and the citizens to conserve and protect Hungary's rich natural resources and water resources, taking into account the interests of future generations. Changes to the relevant legal environment in recent years have created the necessary legal conditions: from the provisions of the Fundamental Law to the Criminal Code, the rights and obligations related to the protection of the environment and nature have broadened considerably. Water protection is a complex activity in which actors from different jurisdictions play a significant role and the most serious infringements are penalized by criminal law. However, criminal law in this respect should also primarily promote the protection of waters and their wildlife by means of prevention. In criminal justice, compliance with the most important environmental protection objective – prevention – should be borne in mind, both through generic and special prevention.
