Abstract

Cél: Az Európai Unió mesterséges intelligenciáról szóló rendelete tárgyi hatályának, alkalmazandóságának vizsgálata a kizárólagos tagállami hatáskörű nemzetbiztonsági tevékenység aspektusából, az azzal kapcsolatos dilemmák megvilágítása, kitérve a „nemzetbiztonság” uniós/hazai jog interpretációjára, a nemzetbiztonsági és bűnüldözési célú tevékenység további dilemmáira a titkos információgyűjtés, a személyes adatkezelés terén.Módszertan: Kapcsolódó hazai és nemzetközi szakirodalom áttekintése, kritikai vizsgálata, dokumentum- és tartalomelemzés, jogforráselemzés és interpretáció, egyéb komparatív elemzési módszerek alkalmazása.Megállapítások: Bizonyításra került, hogy a bűnüldözési érdekkörben akár ideiglenesen eljáró nemzetbiztonsági szolgálat tevekénysége elfogadhatatlan (tiltott) és magas kockázatú MI-rendszer alkalmazása esetén az Európai Unió mesterséges intelligenciáról szóló rendeletének tárgyi hatálya alá tartozik, így az alkalmazandó uniós jogi norma, míg az MI-rendszer kizárólagos nemzetbiztonsági célú alkalmazása nem tartozik annak hatálya alá, egyben azonosítva a határterületeket.Érték: A tanulmány megállapításai, következtetései tudományos alapossággal hozzájárulhatnak az olyan diszruptív technológia, mint a mesterséges intelligencia nemzetbiztonsági célú alkalmazásával kapcsolatos jogalkotáshoz, jogalkalmazáshoz, az uniós jog alkalmazanódáságával kapcsolatos diskurzushoz. | Aim: To examine the scope and applicability of the European Union Regulation on Artificial Intelligence (AI Act) from the aspect of national security activities under the exclusive competence of the Member States, to shed light on the dilemmas related to it, covering the interpretation of “national security” in EU/ domestic law, and further dilemmas of national security and law enforcement activities in the field of secret information collection and personal data processing. Methodology: Review and critical examination of related domestic and international literature, document and content analysis, legal source analysis and interpretation, application of other comparative analysis methods. Findings: It has been proven that in the context of law enforcement, even temporarily, the activities of the national security service in the case of the use of an unacceptable (prohibited) and high-risk AI system fall under the scope of the AI Act. Thus, the applicable EU norm. While the exclusive use of the AI system for national security purposes does not fall under the scope of the AI Act. At the same time, the border areas have been identified. Value: The findings and conclusions of the study can contribute with scientific thoroughness to the creation and application of legislation related to the use of disruptive technology such as artificial intelligence for national security purposes, to the discourse on the applicability of EU law.
