Abstract

Európai uniós becslések szerint, jelenleg mintegy kétmillió gyermek kerülhet olyan hátrányos helyzetbe, hogy szüleit egy másik tagállamban nem ismerik el szülőként. Így történhet akkor is, amikor egy másik tagállamba költöznek vagy visszatérnek származási tagállamukba.A tagországoknak az uniós jog értelmében ma már kötelezően el kell ismerniük a más tagállamban megállapított leszármazást, különösen a szabad mozgásra vonatkozó uniós jogból eredő jogok – mint a másik tagállamba való beutazáshoz és tartózkodáshoz való jog, az egyenlő bánásmódhoz való jog és a gyermek úti okmányainak beszerzéséhez való jog – alkalmazása esetén. Ugyanakkor az uniós jog nem írja elő a más tagállamban megállapított leszármazás elismerését a gyermek nemzeti jogból eredő jogai, például az öröklési, tartási vagy felügyeleti jogok szempontjából. Az Európai Parlament a helyzetet felismerve az elmúlt években több állásfoglalást is kiadott az ügyben, az Európai Bizottság pedig 2022. december 7-én elfogadta a leszármazás elismerésére és az európai leszármazási igazolás létrehozására vonatkozó tanácsi rendeletre irányuló javaslatot. Az Európai Parlament 2023 decemberében támogatta e jogszabálytervezetet, amely biztosítja, hogy ha egy uniós ország megállapítja a szülői jogállást, akkor azt a többi tagállam is ismerje el. A szülői jogállás elismerésével az érintett, jelenleg hátrányos helyzetben lévő gyermekek száma jelentősen csökkenne.A következő lépés, hogy a Bizottság javaslatát az Európai Unió Tanácsának – a Parlamenttel folytatott konzultációt követően – különleges jogalkotási eljárás keretében, egyhangúlag kell elfogadnia. | According to estimates by the European Union, currently around two million children may find themselves at a disadvantage because their parents are not recognised as such in another Member State. This can occur when families move to another Member State or return to their Member State of origin. Under European Union law, Member States are already required to recognise parenthood established in another Member State, in particular for the exercise of rights deriving from the Union’s free-movement law—such as the right to enter and reside in another Member State, the right to equal treatment, and the right to obtain travel documents for the child. European Union law, however, does not require recognition of parenthood established in another Member State for the purposes of rights arising under national law, for example inheritance, maintenance, or custody rights. Recognising this situation, the European Parliament has adopted several resolutions on the matter in recent years, and on 7 December 2022 the European Commission adopted a proposal for a Council Regulation on the recognition of parenthood and on the creation of a European Certificate of Parenthood. In December 2023, the European Parliament supported this legislative proposal, which ensures that where one European Union country establishes parenthood, that parenthood is recognised by the other Member States as well. Recognition of parenthood would significantly reduce the number of children who are currently at a disadvantage. The next step is for the Council of the European Union, following consultation of the Parliament, to adopt the Commission’s proposal unanimously under the special legislative procedure. This study examines the path leading to the adoption of the Commission’s proposed Regulation, the relevant case-law of the European Court of Human Rights (ECtHR) and the Court of Justice of the European Union (CJEU), and the issues surrounding the establishment of the new European Certificate of Parenthood. In addition, the study provides a state-of-play report on the stage currently reached in the Council of the European Union’s deliberations on this file.
