Abstract

Cél: A tanulmány célja az igazságügyi szakápoló szerepének bemutatása a kriminalisztika és a büntetőeljárás összefüggésében, valamint annak vizsgálata, hogy e szerepkör milyen eljárásjogi keretek között és milyen feltételek mellett illeszthető a magyar büntetőeljárás rendszerébe.Módszertan: A kutatás jogdogmatikai elemzésre és nemzetközi összehasonlításra épül.Megállapítások: Az igazságügyi szakápoló a magyar jogrendszerben jelenleg sem kodifikált, sem intézményesített formában nem jelenik meg. A forensic nurse az egészségügyi ellátás során a bizonyítékként értékelhető, a bűncselekmény szempontjából releváns nyomok és anyagmaradványok felismerésében, rögzítésében és dokumentálásában tölt be sajátos szerepet. Intézményesítése erősítené a bizonyítás megbízhatóságát, az egészségügy és az igazságszolgáltatás közötti együttműködést, valamint hozzájárulna a sértetti jogok hatékonyabb érvényesüléséhez.Érték: A tanulmány hozzájárul egy jogilag nem szabályozott, ugyanakkor szakmailag indokolt szerepkör tudományos megalapozásához és hazai bevezetéséhez. | Aim: The study aims to present the role of the forensic nurse within the context of criminalistics and criminal procedure and to examine the procedural framework and conditions under which this role could be incorporated into Hungary’s criminal procedure system. Methodology: The research is based on doctrinal legal analysis and international comparative analysis. Findings: The role of the forensic nurse is currently neither codified nor institutionalised within the Hungarian legal system. In the course of providing healthcare, forensic nurses perform a distinct function in identifying, securing and documenting traces and physical evidence that may have evidentiary value and are relevant to the offence under investigation. The institutionalisation of this role would enhance the reliability of evidence, strengthen cooperation between the healthcare sector and the justice system, and contribute to the more effective exercise of victims’ rights. Value: The study contributes to establishing the scholarly foundations for, and facilitating the introduction in Hungary of, a professionally justified role that is not currently regulated by law.
