Abstract
The fideicommissary substitution has long been used as a suitable means to preserve wealth within the same family for generations: 19th-century codes opposed it in the name of economic liberalism and the freedom of the testator. Substitutions were included in the Italian civil code of 1942, albeit with strong limitations, to maintain at least part of the estate within the family, in line with the fascist government’s policy to promote this institution. After this protective concept faded away, following the reform of family law in 1975, substitutions now survive only in an assistive version aimed at providing support, during their lifetime, to individuals deemed vulnerable.
