Abstract

A magyar büntetés-végrehajtás szabályozása az elmúlt években átfogóan megváltozott, reagálva az állapotokat ért nemzetközi kritikákra is. Az evolutív-deskriptív és absztraháló módszerekre épülő tanulmány bemutatja a novelláris modifikáció előtti börtönvalóságot, a módosítások mögött rejlő, a kódex emberképét formáló új jogalkotói attitűdöket, valamint utóbb e változások gyakorlati leképeződését. A nemzetközi ajánlások betartására felhívó kutatási eredmények azt mutatják, hogy a nagyívű jogszabály-módosítás önmagában nem volt elegendő a büntetés-végrehajtás problémáinak orvoslására. | The regulation of the Hungarian penal execution has undergone comprehensive changes in recent years, partly in response to international criticism on the conditions. This study, based on evolutive-descriptive and abstracting methods, presents the reality of prisons prior to the modifications, the new legislative attitudes underlying the changes that shaped the Act’s concept of figure, and, subsequently, the practical implementation of these changes. Research findings, calling for compliance with international recommendations, show that the extensive legislative modification alone was not sufficient to remedy the problems of the penal system.
