Abstract

Although administrative sanctions are a concept used in all European countries and in EU legislation and practice, there is currently no uniform EU concept or theory of administrative sanctions. One of the main problems in defining administrative sanctions, also at EU level, is their distinction from criminal sanctions and their aspects and the legal nature. As EU legislation is influenced by the main national legal systems, the paper briefly outlines the current views on administrative sanctions in the German, French and English systems and how these have been influenced by the legal environment of the European Union. It also takes account of the impact at EU level, looking in particular at legislative trends in the EU on administrative sanctions, the directions and trends that can be outlined from EU judicial decisions, and the theoretical studies that have been carried out on the subject in EU doctrine. Based on these influences, it assesses the pan-European influences on the theory of administrative sanctions and formulates the theoretical problems related to the repressive function of sanctions
