Abstract
A general problem of civil law and civil procedural law in recent years has become the growing number of legal relationships, in which there is a significant difference in the financial possibilities or legal knowledge of the parties. While civil law offers a wide range of instruments to compensate this inequality (information obligations, liability measures, exclusion of contractual clauses), it is important to take a look at the procedural measures as well. If, namely, the claims of the weaker party cannot be persecuted efficiently, the substantial law measures cannot reach their goals either. That is why the current paper aims to introduce the procedural principle of equality of arms and to draw up a framework for the procedural protection of the weaker parties. The paper is based on the case-law of the European Court of Human Rights, European Court of Justice, sources of EU secondary law and the relevant secondary literature.
