Abstract

A projekt célja az Lisszaboni Szerződés hatásainak átfogó elemzése volt. A kutatás három fő terület vizsgálatára helyezte a hangsúlyt. Az első témakörön belül (a Szerződés horizontális aspektusai) a kutatás érintette az EU-jog és a magyar jog viszonyát, az EU új hatásköri struktúráját, az alapjogok EU-jogon belüli státuszát, valamint olyan aktuális intézményi jogi kérdéseket, mint az EU új vezetési modell és az uniós elnökség. A kutatásunk második iránya (jogegységesítés és a jogharmonizáció egyes lehetőségei) elsősorban a nemzetközi magánjogi szabályozás fragmentáltságát, valamint az uniós szabályozáson belül a jogegységesítés esélyeit, lehetőségeit helyezte az elemzés középpontjába. A harmadik témakörön belül (EU-politikák) nagy hangsúlyt kaptak a az uniós külkapcsolatok alapelvi, cél- és értékstruktúráját, a közös kereskedelempolitika reformját és a fiskális és monetáris uniós aktuális kérdéseit érintő elemzések. A négyéves kutatás legfontosabb eredménye az európai uniós és magyar jog viszonyának tárgyában megjelentetett monográfia (Vörös I.: Csoportkép Laokoónnal. A magyar jog és az alkotmánybíráskodás vívódása az európai joggal), valamint egy tanulmánykötet (Az európai uniós jogfejlődés irányai a Lisszaboni Szerződés után, Szerk.: Vörös I. - Horváthy B.). Emellett számos cikk, tanulmány jelent meg a kutatás során, és három műhelykonferenciát, valamint egy nemzetközi konferenciát szerveztünk a projekt keretein belül. | The aim of the project was a comprehensive analysis of the impacts of the Treaty of Lisbon. Within the first main topic (horizontal impacts of the Treaty) analyses were carried out on the relationship between EU law and Hungarian Law; the new competence structure of the EU; the fundamental rights in the EU legal order; as well as current institutional questions. The second aspect (new prospects in the field of legal unification and the approximation of laws) focused on the fragmentation of private international law, and the chances of a possible unification of the numerous EU provisions. The third topic (policies of EU) attached high importance to the aims, principles, and values of the EU external policies, the reform of the common commercial policy, as well as the current issues of the fiscal and monetary policy of the European Union. The most important result of our four-year research was a monograph on the relationship between EU and Hungarian Law (Vörös I.: Csoportkép Laokoónnal. A magyar jog és az alkotmánybíráskodás vívódása az európai joggal. [Tableau with Laokoon. Struggle of the Hungarian Legal System and of the Constitutional Courts with EU Law]), and a collection of essays (Az európai uniós jogfejlődés irányai a Lisszaboni Szerződés után [Tendencies of the European Legal Development after the Treaty of Lisbon], Eds.: Vörös I. - Horváthy B.). Besides several articles were published during the research; we held three workshops and one international conference.
