Abstract

According to declarations and commentaries, the Convention on the Rights of Persons with Disabilities (CRPD) does not create new rights, only specifies existing ones for persons with disabilities. The right to independent living, however, seems to be an exception. It had not been articulated as an internationally protected human right before the adoption on the CRPD, which makes ascertaining its content somewhat difficult. This will be the aim of this chapter.
