Abstract
THE LAW IN COMMON OF THE EUROPEAN UNION Harmonisation and Codification of Laws (I. The Unification of the Law and Its Alternatives) The foundations are unclear and the US experiment is untested. Mostly the path by codes is longed for. Leeways are also searched for and the Dutch solution with the idea of optionality is widely proposed. (II. Official Expectations and Non-official Fears: The Test by the »Common Frame of Reference«) The »CFR« is seen as a Troian horse, substituting to codification while advancing its continental conceptuality and systemicity, albeit in a way deficient of working democracy. (III. The Dread of a Genuine Legal Code) Mere principles without commonality of culture in the background cannot guarantee legal security. Albeit contracts are the most technical field of all, what is hitherto elevated to a community level is mostly the chaos of casualism. (IV. The Future of the Law in Common) All that notwithstanding, gradual convergence in a kind of frameworking regulation can be surely foreseen.
