Abstract
The complex regulation of agriculture and forestry is constantly evolving because of the continuous conflict between the short-term economic and the long-term ecological interests, and the forester himself often gets caught in the in the web of the law that for him is difficult to interpret. The chain of lawsuits known to the public as the “butterfly lawsuit” is a well-known case in which a farmer from Kokad was standing before the Debrecen District Court on charges of damaging nature. The defendant was acquitted of all charges against him by the Debrecen General Court due to lack of evidence, however, this case raises a number of questions for those dealing with the criminal legal aspect of environmental protection. The present study attempts to provide lessons for those concerned not only about compliance with the law, but also to provide people with more effective protection in a possible criminal proceeding. This study explores the peculiarities of the overlapping fields of agricultural and forestry management and of the criminal law using social science methodologies.
