Abstract
As highlighted by the European Court of Human Rights in Cengiz and Others v. Turkey, the Internet has now “become the primary means by which individuals exercise their freedom to receive and impart information and ideas”. As a result, in many countries around the world, regulating the Internet has become one of the top priorities on the political agenda, albeit with different solutions. In order to put the European Union’s 2020 package of digital regulations into context, it is worth focusing our attention on previous European content regulation solutions and examining what liability constructs these providers –, which are international by nature, so national legislation can only achieve partial results – could expect in relation to the content uploaded to them, and what connections could be discovered by reviewing the early regulation of traditional audio-visual media.
