Abstract

Befogadhatóbb-e az ügyfeleknek az a hatósági döntés, amelyben a hatóság nem a határozat eszközével, hanem a hatósági szerződés jogintézményével hoz végleges döntést? Ezt a kutatási kérdést fogalmaztuk meg, amelyre jelen tanulmány keretében igyekszünk választ adni. Hazánk közigazgatási szervezeti kultúrája erősen hierarchizált, szabályorientált, ehhez képest jelentett viszonylag új megközelítést az egyezség vagy a hatósági szerződés bevezetése. Tanulmányunkban – a fenti kérdés minél pontosabb megválaszolása érdekében – egy összehasonlító elemzés keretében igyekszünk egymással szembe állítani a határozatot és a hatósági szerződést. | Are parties more likely to accept a decision by an authority where the authority does not take a conclusive decision by means of a decision, but by means of an authoritative contract? This research question is the focus of our study. Our country has a highly hierarchical, rule-oriented administrative culture. In this organisational culture, the introduction of the settlement or authoritative contract is a new approach. In order to answer the above-mentioned research question as precisely as possible, our study will attempt to contrast the conclusive decision and the authoritative contract in a comparative analysis.
