Abstract

A 2022 áprilisában Magyarországgal szemben elindult kondicionalitási eljárás ráirányította a figyelmet arra a kérdésre, hogy bíróság eldönthet-e politikai vitákat. Az eljárást szabályozó uniós rendeletet Magyarország és Lengyelország is megtámadta az Európai Unió Bírósága (EUB) előtt, ezekben a perekben ítélet is született már, de még további bírósági ítéletek is várhatóak az eljárással összefüggésben. Az EUB azzal, hogy érdemben elbírálta a keresetet, a politikai vitát jogvitává tette. Ha az EUB folytatja ezt a megközelítést, elősegítheti e viták moderált keretek között tartását, és hosszabb távon akár egy valódi európai politikai közösség létrejöttét. | The recent rule of law or conditionality mechanism against Hungary has drawn attention to the problem of whether a court can decide political disputes. The EU regulation governing the mechanism has been challenged by Hungary before the Court of Justice of the European Union, and a judgment has already been handed down in this case. Further court rulings regarding the procedure are also expected. By ruling on the substance of the case, the CJEU has turned the political dispute into a legal one. If the CJEU continues with this approach, it can help to keep these disputes within a moderated framework and, in the longer term, even contribute to the creation of a genuine European political community.
