Abstract
This article constitutes a continuation of a previously published study that provided an overview of the regulatory background and legislative history of the subject. The present paper shifts focus to the actual regulatory innovations introduced in connection with the topic indicated in the title, along with the legal dilemmas they raise – some of which are addressed through the author’s own proposals and reflections. Special emphasis is placed on the concept of conformity with the contract in relation to digital content and digital services under Directive (EU) 2019/770, particularly the conjunctive framework of objective and subjective conformity criteria introduced by the Directive, the legal implications of non-conformity (i.e., lack of conformity), and the consequences arising therefrom – with particular attention to the issue of updates. To a lesser extent, the study also touches upon a particularly intriguing aspect of the Directive: the novel provision that permits the consumer to “pay” for a digital service by providing personal data as consideration under the contract.
