Abstract

Hungarian society was preparing for a political transition at the end of the 1980s, a process that concluded with the parliamentary elections of 1990. The underlying social processes that led to this point are the subject of the latest research. Legal history also plays a role in uncovering these developments. This paper reveals a segment of the legislative and codification work that led to the regime change of 1990. The study presents the history of Jogpolitika, the journal of the Ministry of Justice, from its founding in 1981 until the end of the 1980s. In the journal, we can trace how the professional team responsible for legislation within the Ministry of Justice began rebuilding the foundations of a democratic, parliamentary legal order, and how they regulated legal fields that had previously been completely alien – or even prohibited – within the legal system of “socialist democracy.” Although the journal was a ministerial publication of the socialist government of the 1980s – so one might assume that time has moved beyond it – its pages still contain the imprint of the lawmaking that prepared the regime change, even if this was not yet foreseen at the time. They reflect the process of intellectual and legislative gestation that became one of the foundations for the birth of the later parliamentary democracy and the possibility of transition. Jogpolitika thus serves as a mirror of this important, brief, yet legally and historically significant period.
