Abstract

For about a hundred years, Hungarian historiography has been dominated by Gyula Szekfű’s view that the so-called Croatian Pragmatic Sanction was the brainchild of Count Imre Esterházy, Bishop of Zagreb. Since then, numerous authors, mainly Hungarian, have repeated the thesis that the bishop of Zagreb proposed the Habsburgs’ female succession out of personal ambition, hoping that the king and emperor would appoint him archbishop of Esztergom and primate of Hungary. Hungarian constitutional and legal historians also agree that the article regulating female succession was introduced by the Croatian Diet (Sabor), but they argue that it did not have the prerogative to decide on the monarch’s right of succession, as only the Hungarian Diet was entitled to do so. Therefore, the Croats could have submitted the above proposal to the Hungarian Diet in Pozsony, where the issue could have been discussed. However, Croatian jurisprudence has no doubt about Croatia and Slavonia’s right to elect a king and their authority to adopt the Pragmatic Sanction, which is listed as one of the most important elements of the continuity of their statehood in the preamble to the constitution in force since 1990. This study examines the powers of the Sabor, the process of adopting Act VII of 1712, and, above all, analyzes its legal and political consequences.
